Un estudio calcula que el mercado ilícito de cigarrillos electrónicos en Europa representa el 48% del total anual vendido, lo que supondría un valor total estimado en más de 6.600 millones de euros en 2024, aunque para el cierre de 2025 podría haber superado ya los 7.200 millones de euros.

El estudio, presentado este jueves, ha sido realizado por el Instituto Fraunhofer IIS, uno de los principales centros de investigación aplicada de Europa, y responsabiliza de la situación en gran medida a la legislación irregular de los países europeos, lo que "alimenta los incentivos para el comercio irregular", pero también a las importaciones ilícitas de fuera de la Unión Europea (UE).

"La legislación nacional y las diferencias en los impuestos crea considerables diferenciales de precios y mercados, lo que alimenta los incentivos para el comercio irregular", asegura el estudio, realizado en colaboración con MRU GmbH (especializada en emisiones industriales y comerciales) y la consultoría SKR.

Además, el estudio apunta que el 90% de los cigarrillos electrónicos que se importan a Europa provienen de China y una "gran parte" se produce de manera irregular. También cifra en el 3,1% el número de menores con 15 años o más que prefieren estos productos a los tradicionales de tabaco, con una tendencia que "está aumentando".

ESPAÑA ESTÁ POR DEBAJO DE LA MEDIA, PERO ROZA EL 40%

En España, el mercado ilícito combinado de líquidos y dispositivos desechables está por debajo de la media europea y se sitúa en el 39%, superior a la vecina Portugal (30%) pero inferior al caso francés, donde representa el 58%. En Italia, por ejemplo, alcanza el 44%.

Así, el estudio estima un crecimiento anual del mercado ilícito de este tipo de productos del 8,6% anual, lo que para 2030 elevaría el valor de lo vendido hasta los 10.830 millones de euros.

El documento califica la situación de "reto" para Europa y propone "una respuesta coordinada e integrada de toda la UE, que incluya una combinación de regulación armonizada y la participación cercana de socios internacionales, especialmente China" para ejercer mayor control sobre las importaciones.

Según la información recabada, consideran que "las medidas nacionales unilaterales y la mera estrategia prohibicionista se ha demostrado inefectiva" y sostienen que, de hecho, tiende a "favorecer la expansión del mercado gris y negro a través del libre comercio dentro de Europa.

Asimismo, explican que serían necesarios "mecanismos de control efectivo y transparencia" para "prevenir que el mercado" encuentre "otras alternativas de evasión".

LA PÉRDIDA DE RECAUDACIÓN VARÍA; EN ALEMANIA ROZA LOS 120 MILLONES

El estudio pone el foco también en la pérdida de recaudación fiscal, que explica podría variar de país a país por varias circunstancias, aunque sí le pone valor a lo no recaudado en Alemania, donde rozaría los 120 millones de euros anuales.

"Un gran mercado irregular causa significativas pérdidas en recaudación fiscal. En Alemania solo, el Gobierno pierde millones en impuestos del tabaco e impuestos sobre el valor añadido. Esa pérdida en Alemania puede asumirse que alcanza los 119 millones de euros", detallan.

"INCALCULABLE" RIESGO PARA LA SALUD

Este mercado gris (de productos legales pero no autorizados a su venta en ese mercado) y negro (robados, falsificados o sin control sanitario ni de ningún tipo) genera, además, un "riesgo incalculable para la salud de los consumidores".

"Cigarrillos electrónicos irregulares pueden contener sustancias no testadas con efectos no probados. Este riesgo se puede manifestar en envenenamiento y efectos adversos para la salud a largo plazo", apuntan.

Así, el estudio considera que esta situación desatiende la protección a los menores, porque el mercado ilegal obvia los controles de edad, haciendo "especialmente fácil para la gente joven acceder a los vapeadores".

Por último, resalta que la permisividad con el mercado ilícito es injusto con los legalmente establecidos, que "pagan impuestos y cumplen con las regulaciones". "Socava el mercado regulado y pone en riesgo el modo de vida de muchos pequeños comerciantes", sentencia.
